if you win a small settlement (<10k), who does the insurance company write the check out to, me the attorney or both?

Settlement checks are typically made out to the attorney and the individual. This ensures that the attorney gets paid whatever his fee is.

If you have an atty, the check will be made payable to both, regardless of the size of the settlement.
