Legal Question in Personal Injury in Pennsylvania

My father-in-law was killed 6 months ago in an industrial accident. A co-worker's weld broke causing a 600lb metal tray to fall on him. The OSHA report concluded that the co-worker did an improper weld causing the break. My mother-in-law has received workmans comp. Is there any way to go after the company for wrongful death? If she gets the workmans comp, is it possible for his son ( my husband) to sue the company for a wrongful death? Could she give the workmans comp back in return for a lawsuit? Bottom line is that it was the company's fault for his death, is there ANY way to have a lawsuit against them???

You better believe there are other ways you may have a lawsuit. You see, in any industrial accident, there are often many other entities that may have contributed to the death. So, even if your father in law's company is protected by workmans comp, there may be many other entities on site who had products or services that contributed to the death.
