Legal Question in Product Liability in Pennsylvania
Prescription drug found in Food Product
I bought a sugar replacement product - a tablet form - and discovered a pill in it. I called the Center for Disease Control and thet identified the pill to be a prescription drug. I contacted the manufacturer of the product and was told to just return it too them and they will send me a coupon for a free replacement. There are 100 tablets per container and there was about 25 left when I discovered the pill. I did not use this pill but I'm concerned about the ones I might have taken without knowing. Do I have a case?

Re: Prescription drug found in Food Product
Assuming you can prove that the pills were improperly included in with the sugar replacement product, the manufacturer could be responsible. However, in order to pursue a claim, you must have suffered measurable damages. You should go to a doctor and make sure you are all right. If there is no injury, there is no reason to pursue the matter.
