Legal Question in Real Estate Law in Pennsylvania
Can we add my name to our Deed using a Quit Claim Form?
My husband is currently the only name listed on the Deed to our house. We would like to add my name to the Deed. I have been quoted by some lawyers to write a new Deed, and someone told me I could simply use a ''Quit Claim Form'' to add my name. We would list my husband as the Originator and then the both of us on the new Deed. Is this Legal? If not, is there something we can do besides having a completely new Deed created?

If there is no mortgage on the house a deed transfer can be effective. My one caution is that a quit claim deed on a house's property history may reduce it's value. You should look for a general warranty deed.

You would be foolish to draft your own deed, this in turn could cause you problems with your title insurance now or for future purchasers. A Real Estate Attorney should be willing to draft this for you for about $100-200, which considering the value of the home is well worth it.
As it relates to a quit claim deed, you would be sacrificing a decreased value to the property if you acted in this manner. The bottom line is hire an Attorney and spend a couple hundred to save tens of thousands later.
