Legal Question in Real Estate Law in Pennsylvania
Apartment Lease
I signed a lease in May for my daughter in college. I just received another lease saying the rent quoted was incorrect and the price was increased by $250. When I called the real estate agent he said there was a typing mistake and that I should have known the correct amount of the rent since it was on their website.
Can he change the amount due to a typing error? I told him I went by the lease I signed and never say the website.

Re: Apartment Lease
A lease is a contract. In your case its a written contract drafted by the landlord. As such a court will enforce the contract a written. The website is what is known as parol evidence. That is a polite way of saying inadmissible. The court will look to the "four corners" of the contract. I doubt a web site exists with in the lease. Further, when a contract is unclear or ambiguous it will be interpreted against the drafter, in this case the landlord.
Assuming they lease more than one apartment they should have caught the "error". In any case before either party signs a contract or lease it should be read. That applies to the landlord as well as the tenant.
