Legal Question in Real Estate Law in Pennsylvania
Apartment Rental - Landlord's death
My landlord died last week and his family does not know if he has a will. My rent is due soon and I do not know who I am to give this to. In my lease agreement with the deceased landlord, he pays all utilities. I need to know who I should give my rent to, his family who as of right now has no legal ownership over the property. And how do insure that the utilities will be paid.

Re: Apartment Rental - Landlord's death
First of all, I would make the check payable to the "Estate of (insert your landlords name)". This will force them to open an estate. If the property is in the decedent's sole name they will most likely need to open an estate to transfer the deed anyway.
Second, if your rental agreement states that the landlord is to pay the utilities, I would highlight that language and mail a copy of it to the person that has been in contact with you.
If you have additional questions or if you feel they need someone to clear up the issues of the estate, please feel free to contact me or pass on my information. Thanks.
