Legal Question in Real Estate Law in Pennsylvania

Apartment Water Shut off

My landlord has been having water department troubles, but assured me that there was no problem. He called me at work and told me that there plumbings issues that his maintinence guy was looking in to. I called the water dept. and was told the water had been shut off due to non payment. I was without water for two days. My children and I had to leave my home and stay elswhere until it was resolved. I took the day off from work to wait for the maintence man to come to find out what the problem was- which never happened- there was nothingthat he needed to fix. Do I still have to pay rent for that time? It was two days, and a complete inconveniece to my family and those I had to ask to house us until it was taken care of.

Re: Apartment Water Shut off

I suggest that you attempt to resolve this issue with the Landlord. You are possibly are entitled to a credit. However, you may have to sue the Landlord to collect it. I suggest you consult with legal counsel or file a law suit in small claims court to protect your interest. If a property is not habitable you have the right to place the rent in escrow. No action should be taken without a detailed review by legal counsel. Gerald Hershenson Esq. 215-579-9390
