Legal Question in Real Estate Law in Pennsylvania

Appealing a Zoning Variance?

My town's Zoning Hearing board granted a variance to allow my neighbor to construct an apartment that violates setback requirements, despite my protests and evidence that it would violate my privacy, etc. I would like to appeal without hiring an attorney. What information, forms, etc., must I submit to file the appeal?

Re: Appealing a Zoning Variance?

You should consult an attorney immediately. You have thirty days to take an appeal from the decision as long as you appeared before the zoning hearing board. An attorney can review the facts to determine if you have a chance to set the decision aside as an abuse of discretion. However, if the thirty day period has elapsed your right of appeal will be terminated. Gerald M. Hershenson Esq. 215-579-9390
