Legal Question in Real Estate Law in Pennsylvania

Bankrupt Landlord

We got a notice that our house was up for sheriff's sale on April 2, it was postponed til June 5th because our landlord filed for bankruptcy. Do we have to continue to pay rent or can we withhold until this issue is resolved? also can we move out if he will not be able to fulfill the entire lease?

Re: Bankrupt Landlord

If you have a lease, you may remain in the home. You should contact the attorney for the lender in the foreclosure [the name should be on the notice you received], to ask about rent payments. You should not make them to your landlord, but may be required to pay them to the lender or to the Bankruptcy Court Trustee, if one has been appointed.
