I purchased a new home in Feb. of 2003. At that time, I submitted a punch list to the builder and he still has not corrected a major problem on this list (leaking basement). He attempts correcting the problem but has not been completely successful. He does check the property from time to time (as he is my neighbor, as well) when I had brought to his attention, a new and rather distressing problem. The ceiling, of the third floor, is cracking and caving in. He stated that the flashings on the roof, are not allowing heat to escape from the house. He said that the roofer must come out and fix the roof, before he can fix the interior. This conversation took place in May. I have communicated to him, several times, that the problem is getting worse and now, the floor is buckling. His answer has been, well, the roofer isn't making this a priority since he's not getting paid. What legal recourse do I have?

If the builder and roofer are unwilling to remedy the problem in a timely manner, then you may need to consider bringing legal action against one or both of them for breach of contract or warranty. To discuss this matter further, feel free to contact me by phone or e-mail.
