Legal Question in Real Estate Law in Pennsylvania

buyer/renter

we are buying a house and the person renting it says either we or the seller has to buy out the lease, but the renter has not paid his rent in full till the end of the lease in August 2009. Do either of us owe him anything?

Depends on what the lease says on what is owed to the renter. As a buyer of the property you are entitled to by it free and clear of any encumbrances. A lease is an encumbrance. Its just like if the seller had a mortgage on the property. It would be the sellers duty to clear the mortgage. Therefore, the removal of the lease is the sellers problem.

This is why when buying or selling property its a good idea to have a lawyer that answers only to you.
