Does the law require a certificate of occupancy before property can be transferred and occupied?

All new construction properties do require a certificate of occupancy to be issued before conveyance to the first buyer/occupier.

Each township or municipality has different requirements about certificates on sales of other than new construction. You should check with the township where the property is located. This is usually the responsibility of the seller, unless parties have agreed otherwise.
