after going to closing seller wont vacate property
Went to settlement on property completed transaction with title agent.seller will not vacate house and has seeked legal council saying that he sold his house to cheap wants out of the deal wont vacate property . what do i do?please help ....--name removed--

Based on what you told me you have two options....option number one do nothing and walk away, you are looking at a legal dispute that may take anywhere between 6 months to one year....but my recommendation is option number two, basically you should retain an attorney and sue this individual for damages and specific performance, meaning you force him to sign the house over to you....if he already did sign all of the documents and accepted your money from the closing company then you would need to seek legal recourse to evict this individual....you have a tough road ahead, but once you start you will most likely be victorious...best of luck.

The facts you provided in your question do not give enough detail to give you accurate advice. You must obtain legal counsel at this point. Was property transferred to you? If the Seller refused to honor agreement of sale, you have to bring a legal action for specific performance. If you have a written agreement of sale and met all the condition, you can legally force the seller to transfer title. But get an attorney immediately. Gerald Hershenson Esq.
