Legal Question in Real Estate Law in Pennsylvania

Coal Company Trespassing

The coal company down in my area, came onto our property without permission or advanced warning, nor did they know they were on our property. In the process they cut a road thru our property and knocked down numerous trees. I would like to know what I can do about this.

Re: Coal Company Trespassing

I suggest you consult with legal counsel. The coal company might have a recorded easement that allows them to enter your propery to establish the road. However, a title search would reveal their rights and your obligations. You need such a search to verify the right of them to act. You might want to contact the coal company and get the information from them if you do not want to incur the expense of a title search. I am sure they would not enter your property unless they have some authority. Also, you might want to check with the zoning officer of the town you live in to request some assistence in finding out your rights. Gerald Hershenson 215-579-9390
