My mother in law owned a small property there for 40+ years. About 10 yrs ago she signed the property over to her four children. One of the children died and nobody can find his common law wife. They want to sell this lot for about $3,000, but his name is still on the deed. How can they get it off without spending more than the property is even worth?

A new deed should be prepared and recorded with a certified copy of the death certificate of the sibling who died. The attorney who prepares this deed should also be able to advise regarding the apparently unlocatable

common law spouse of this sibling and the likely effect of this circumstance as to the issue of marketable title.
