Legal Question in Real Estate Law in Pennsylvania
I have a creek that runs through my property. In my deed, it described one of the four property lines as running "through" the creek as verified by the lot plan on file in the Courthouse. The problem is that the creek has moved about 15'-20' in the 30 years since the original survey was done. The adjacent property owner claims he owns to the creek and I say that he does not. I had the property surveyed and my markers are well beyond the creek. Who is correct?

It might have to go to court. However, since you had the property surveyed and your way beyond the creek, that might be sufficient evidence to win. Attorney Michael Kotik of www.LegalPhilly.com
