Legal Question in Real Estate Law in Pennsylvania

deceased party on deed how to file new

My husband was married once before. His first wife is deceased. The house is still deeded to the two of them. We would like to file a new deed with his name and my name on it. How do we do it? What do we need to do. What form do we need to use as we are hoping we can do the necessary paperwork ourselves.

Re: deceased party on deed how to file new

Unless there was a divorce agreement to the contrary, the first wife's estate still owns one half of the property. Your husband can only convey his one half interest. I suggest you consult an attorney. The matter is potentially complicated for you to do properly on your own. Gerald Hershenson Esq. 215-579-9390
