My name is not on the deed

Married to my husband for the past 12 years. Bought our house about 5 years ago. My name was not put on it because of my poor credit. A year later I recieved some money from my mother passing, and out right paid off the house in full. My husband refuses to add my name to the house deed. I have all paper work showing I paid it off. If we were to divorce who would get the house, or would it be 50/50 or how would that work?

You asked about possible division of marital property.

Just because your name is not on the deed means little. Though it is not irrelevant. The property would generally be divided 50-50 not respecting your large payment.

The courts would instead look at the large payment of money from an inheritance as money that should be returned to you. There are some arguments that once the money was co-mingled it became a marital asset. But the arguments are almost as strong that you should retain the benefit of the inheritance.

Make certain you have your records.

Better yet reconcile and remember why you got married in the first place.
