easements

I live in a private community and have a drainage ditch in front of my house installed by the community excercising their easement. my qeustion is, who is reponisble for the maitenence of it? When my house was built a drainage pipe was installed by the builder, but it needs to be replaced. who is responsible? also who is responsible for cleaning debris from it? only a few people in the community have a drainage ditch. your input will be greatly appreciated. i live in PA.

Re: easements

There should be documents that provided for easements and for responsibility for maintaining any such easements that were recorded prior to your purchasing your house.

It is customary for the Home Owners' Association to share the costs of maintaining many aspects that do not serve only one property.

You should take all of the documents relating to your community and your purchase of the house to an experienced real estate lawyer in your county to advise you.
