Encroachment Issue

builder put in a retaining wall for my neighbor. The wall is on my property. Real estate agent said I may not be able to sell until the issue is handled. What are the options? Easement? Deed property to neighbor? Move wall? Simply disclose it? Any help is appreciated

You can not convey the wall by deed. You can grant an easement to your neighbor or force him to tear the wall down. You neighbor should assume full liability for maintaining the wall if an easement is granted. This obligation would be in the easment. Suggest you consult legal counsel. Gerald Hershenson Esq.
