I signed alease with my brother to rent the top of his house,he left town without telling anybody,in late december i found an eviction notice in the basement sayinyg myself and the downstairs tenant are being evicted on jan.22nd,but we had no idea about this,and my brother return any of my phone calls,i don't want be on the street,is there any way i would be able to keep the house by working out some kind of payment plan.

Sounds like a great brother...however, as previous counsel stated, contact the Landlord and see if you can work out an arrangement. If not, retain legal counsel immediately, an attorney can help you delay an eviction upwards of 2-3 months or longer.

Generally all you need to do to be in your landlord's good graces is to pay the rent that is due. Call him and make arrangements to pay the rent in full. Borrow from someone else if you have to. Don't ask the landlord to borrow from him - he has agreed to provide the place that you are living; he has not agreed to be your banker. If the choice is having you offer to pay only a portion of the rent now, with a promise about later, most landlords would prefer to move forward with the eviction, and get a new tenant who pays the rent in full nad on time.
