Legal Question in Real Estate Law in Pennsylvania
My father is being investigated for fraud because he bought two homes. He lives in one and lets his stepdaughter live in the other and she pays the mortgage. The real estate agent knew my father would be doing this with the 2nd home. Instead of writing up the paper work as a rental home he did it as my fathers primary home. The bank said that my father committed fraud because the loan given to him for the 2nd home would have been different in every way. My father didn't know there were different loans for other types of home purchases. He trusted that the agent knew how to do his job. How can my father get out of this mess and can he sue the real estate agency?

Under what circumstances did the claim by the bank arise?
One of the documents the borrower signs at mortgage loan closings is a statement that the home is intended to be for the borrower's personal residence. This could be the basis for a fraud claim.
Your father should be consulting with a lawyer in the area to represent him in the fraud matter.
This response is not legal advice, since I do not have all of the information that would be required, and I do not have a representation agreement with you.
* If the answers to your question confirm that you have a valid issue or worthwhile claim, your next step should almost always be to establish a dialog with a lawyer who can provide specific advice to you. Contact a lawyer in your county or township.
* Another reason for contacting a lawyer is that it is often impossible to give a good answer in the Internet Q&A format without having more information. The unique circumstances of your situation and things that you may not have thought to mention in your question may completely change the answer. If you want to be sure that you have a complete answer to your question and an understanding of what that answer means, establish a connection with a lawyer who practices in the area of your concern.
