Home vs. Nursing Home

My mother-in-law has owned a home. She had medical problems and we sold our home 8 years ago to move in with her so she did not have to go to a nursing home. We have been living here 8 years. She has a trust fund she takes money out of occasionally. She is coming to the point that she may be placed in a nursing home. She has long term care insurance that will last 1 year. What happens to the home if we are living here for 8 years? She is now exhibiting signs of Alzheimers but not yet diagnosed as such. Where do we turn from here? Thank you.

Run, do not walk, to an experienced "Elder Law" lawyer to assist you and your mother-in-law with planning at this stage. So long as she still has mental capacity, she may create necessary documents including Will, Durable Power of Attorney and Health Care documents. The lawyer would also have to see the entire trust agreement to determine what your mother-in-law's rights are under the trust.
