Legal Question in Real Estate Law in Pennsylvania
Homeowner Associations
I need an attorney to help me fight our Community Association, their property is destroying mine. They have property next to mine that is accumulating water and the water is flooding my property - destroying my driveway and any shubbery I plant, my railroad ties. I have to go out in boots just to get to my car. I have asked that they do something to avoid this problem. It appears that there was a petition with the last owner to get them to do something and nothing was done. I need to know what is my recourse. They have a drain on the property that is not working correctly. They can fill the property to avoid some of the water - I have also indicated that if they can not build a retaining wall on their property I would give them access to mine. What can I do? Thanks

Re: Homeowner Associations
Well at this point I would recommend retaining an attorney to represent your interests as soon as possible. An attorney would contact the individuals and act as an emissary on your behalf to negotiate, if possible, a deal. If your neighbors are unwilling to settle this matter amicably, your attorney would advise you on what relief you may have available!
Your case depends partially upon your rights to the land as well as the homeowners association agreement, and without reviewing this information it would be improper for me to advise you any further on this matter.
My office also offers flat rate pricing and free consultations, for additional information please visit my firm's website at www.AlleghenAttorneys.com or by calling my office at 412.731.0865.

Re: Homeowner Associations
I agree the entire situation should be reviewed. You might have to institute a legal action to enjoin the association from further damaging your property. However, you would need some expert testimony as to the cause of the damage. An attorney should be able to assist you. Gerald Hershenson 215-579-9390
