Legal Question in Real Estate Law in Pennsylvania

Homeowners Assocation

I was recently elected to my community Homeowners assocation. The By laws indicate the that all board members will elect the officers, during today's meeting I found out that the President selected the officers. She indicated that that was the way is was always done. My question is, what steps can I take when the bylaws are not followed as written.

Re: Homeowners Assocation

Bring this matter up at the board meeting and have the Bylaws at hand. It does not matter if this is the way it's always been done. This is improper. Corporate governance is set up beforehand to avoid abuses of power. In this case it is obvious that too much power is centered on the president.

The president is an executive and should also be appointed by the board. Stand up for yourself and defend your position.
