Legal Question in Real Estate Law in Pennsylvania
My husband and I did a land contract with a former tenant. He is on the 5th year of his 15 year mortgage with us and is almost eleven months behind on his payment. We have had the Code Enforcer contact us at least half a dozen times for the filth and several other code violations on the property. The property taxes were in default until just a couple of months ago. The man buying the house had a stroke and heart attack about 9 months ago, so he is no longer working. My question to you is: How do I write up a foreclosure on this house so that I can take ownership and control of it again and how long does it normally take in Pennsylvania to go through the whole court procedure, eviction, etc?

It depends but the most important thing is your written contract which will spell out the default provisions in cases such as these. After you examine the agreement then you provide the tenant with their right to reinstate the mortgage and then start the foreclosure proceedings. They are complicated and you may want to hire an attorney
