Legal Question in Real Estate Law in Pennsylvania
My husband lives in Philadelphia, PA and I live in NC with our daughter and her family. He is 62 and has disability and retirement income. He wants to live in NC now. We have decided to sell our home and part of the proceeds will go to purchasing a new home in NC with our daughter and her family. We have five children and all are aware of our plan. We both have serious health issues. I want our daughter to hold POA for both of us. She currently has both our medical POA. It is our plan to give a monetary gift to our four other children from the sale also. I want to protect my daughter's interest in case something happens to both of us. What would be our best course of action.

You and your husband should consult with Elder Lawyers who could counsel you on medicaid and elder law issues BEFORE you transfer any assets in whole or in part to your children, because that could affect your and your husband's disability income and benefits.
THIS RESPONSE IS NOT LEGAL ADVICE, SINCE I DO NOT HAVE ALL OF THE INFORMATION THAT WOULD BE REQUIRED, AND I DO NOT HAVE A REPRESENTATION AGREEMENT WITH YOU.
* If the answers to your question confirm that you have a valid issue or worthwhile claim, your next step should almost always be to establish a dialog with a lawyer who can provide specific advice to you. Contact a lawyer in your county or township.
* Another reason for contacting a lawyer is that it is often impossible to give a good answer in the Internet Q&A format without having more information. The unique circumstances of your situation and things that you may not have thought to mention in your question may completely change the answer. If you want to be sure that you have a complete answer to your question and an understanding of what that answer means, establish a connection with a lawyer who practices in the area of your concern.
