Getting land/building papers back to actual owner from other family member
Currently in Pennsylvania we legally own land with a home on it. We're trying to get the deeds and other necessary paperwork, with our names on it, back from another family member. The family member has refused to send it to us. We intend to sell the property and building and cannot do so until the paperwork is returned to us. What legal measures can be taken to obtain this paperwork. As stated before our name is on all of the necessary paperwork pertaining to the land and real estate on it.

Deeds are kept in the Recorder of Deeds office for the County where the property is located at. You should be able to get the office to mail you appropriate copies for a nominal fee. Otherwise you will be forced to bring an action to force the other person to act. I offer free consultations.

If you are in legal title, you do not need a deed to transfer ownership. All that is needed is the county tax parcel number. A copy of the deed can be obtained from the Recorder of Deeds, but is not needed to prepare an agreement of sale. If the family member that has the deed is also in title, you situation is more complicated. In that case the property can not be sold unless ordered by a Court. I suggest you consult legal counsel.
