My son's school district says they have to have a current lease as proof of residiency and our lease expired last year, our landlord hasn't or won't give us a new lease. Does he have to give us a new lease or is the school district wrong in not allowing my son to return to school in the fall without a note? I think I could probably get a note from the landlord stating where we live, of course the school won't accept a signed note from my landlord as proof of residiency.

I would also like to add that in addition, the school also wants copies of utility bills, phote i.d. and tax forms/or copy of most recent paycheck as additional forms of proof.

Is it legal for the school to keep a child out of school because I can't get a new lease from my landlord?

Many leases say that if they are not terminated at the expiration of the term, then they automatically renew for another period equal to the original term. If that is what your lease says, perhaps you could use a copy of the lease, highlighting that provision, together with yoru affidavit saying that there was no termination by you or the landlord, as evidence of a current lease.

If your landlord is willing to give a note saying that you live in the property, wouldn't the landlord sign a similar affidavit?

The rest of the requirements do sound intrusive. Are you the only one being asked for this information, or is it required of all families with children in the school district?
