Legal Question in Real Estate Law in Pennsylvania
How long does a company have to take a lien off your property once it is satified in full?
1 Answer from Attorneys
What kind of lien? You have to make a written demand on a mortgage lender to have a satisfaction or release provided in recordable form. If they don't comply within 60 days, there would be a penalty. For other liens, such as judgments, you should have a written agreement that upon payment in full, a recordable release or judgment satisfaction will be provided and that the lawyer for the lien-creditor will file the necessary papers with the court to have the court docket (record) show that the lien was satisfied.
If you are trying to have a lien removed from your property, consult a lawyer to make sure that it happens, is completed, and that a lien search on your property will not that that lien anymore. Otherwise, you will keep running into the problem, and it will cost you more to deal with it. Plus, any action that you're about to take, such as refinancing or selling your property will be delayed or cancelled because you won't be able or in a position to clear the lien by the time you have to under the contract.
THIS RESPONSE IS NOT LEGAL ADVICE, SINCE I DO NOT HAVE ALL OF THE INFORMATION THAT WOULD BE REQUIRED, AND I DO NOT HAVE A REPRESENTATION AGREEMENT WITH YOU.
* If the answers to your question confirm that you have a valid issue or worthwhile claim, your next step should almost always be to establish a dialog with a lawyer who can provide specific advice to you. Contact a lawyer in your county or township.
* Another reason for contacting a lawyer is that it is often impossible to give a good answer in the Internet Q&A format without having more information. The unique circumstances of your situation and things that you may not have thought to mention in your question may completely change the answer. If you want to be sure that you have a complete answer to your question and an understanding of what that answer means, establish a connection with a lawyer who practices in the area of your concern.
