Legal Question in Real Estate Law in Pennsylvania

Lost Quit Deed Claim

Last September I purchased my home from my ex-boyfriend (we had purchased our home together in January 2000). I got my own mortgage and he signed a Quit Claim Deed. Six weeks ago he went to file bankruptcy and his lawyer discovered that the county court had never filed the mortgage papers and the originals were lost. The original title company has since gone bankrupt and I did find a spin-off company that has copies. The court will not accept a copy and my ex will not resign the Quit Claim Deed without receiving money. His lawyer contacted me and wants money from me. This is not my fault that the court lost my documents. What can I do next?

Re: Lost Quit Deed Claim

I suggest you consult an attorney. You may have a claim against the title insurance company even if the agent is out of business. This is very messy situation and it can only be resolved with legal assistence. Your boy friend could possibly be forced to sign a new deed or the title can be cleared by a court order. If I can be of any help let me know. Gerald Hershenson 215-579-9390
