Legal Question in Real Estate Law in Pennsylvania
mineral rights removed from surface property
I found out that I do not own my mineral rights, my aunts and uncles and mother own them.
Will there be a separate mineral deed filed at the county courthouse?
Are mineral deeds treated like surface property deeds?
The mineral rights are divided 5 ways. If i want to get a gas well drilled is 3/5 in agreement enough to get it done or do they all have to agree.

Re: mineral rights removed from surface property
There will be two deeds on file. Assuming that the property rights have only been divided into two parts. One deed will cover the surface rights and the other will cover the subsurface or mineral rights. Both interests must cooperate in order to exploit the subsurface rights.
This is a very complex area of law that cannot be properly addressed in this forum. I would have to examine the deeds and any agreements that were subject to the deeds. Also a review of the law in this area would be necessary to confirm what form corporate action must follow.
