3 years ago my husband and I bought our house from a man who financed us, he was wealthy and owned several houses and he financed us- we went to settlement and are the owners of the house. He recently died and his daughter is the executer of his estate. Our Mortage payment goes every month to his estate. Recently my husband lost his job and we slipped behind on the morgtage, I have been paying my monthly mortage as well as extra money until I get caught up- I send extra money every few weeks and the regular mortage every month. The daughter leaves phone messages threatning to foreclose on us and she is extremely nasty, telling us all of the time how she spoke to her lawyer. I am doing everything I can to get caught up. Today she left a message saying that she spoke to her lawyer and he told her that it is her right as the ''lender'' to tour our house and she wants to come over tomorrow night for a tour. I told her that I would not agree to her coming into our house until I actually spoke to her lawyer myself... Is this true? does she have the right to come an ''tour'' our house as she pleases? I have no idea what to do and she is so rude and threatning...Can you please tell me if this is law; and what our rights are as the home owner?

I suggest you hire a lawyer. Foreclosure is Pennsylvania is a long drawn out process. Notices need to be sent before foreclosure I would not voluntarily let her in the property. She is attempting to verify whether you are damaging the property. Try to negotiate a resolution and then allow her in the property as part of an overall settlement.You need a lawyer at the earliest possible time to assist you. Gerald Hershenson Esq.
