Legal Question in Real Estate Law in Pennsylvania

My mother died without establishing a Will. I have brothers who neglected the property. Her house caught on fire and I do not know what to do legally. The house is still in her name. I do not want to walk away so what must I do to clean up this mess.

Condolences on your loss. Your mother's estate must still be administered. You may apply to be appointed as administrator by going to the Office of the Register of Wills in the County where she resided with an original Death Certificate. You will have to satisfy the Register of Wills that your brothers will agree to your being the administrator, by their signing a "Renunciation", a form that is available at the Office of the Register of Wills. Staff at that office are usually helpful. Once you are appointed, you will be able to submit a claim to the insurance company, if there was insurance on the house. If there was no insurance, you will have to decide what to do with the property. If that is the case, it may be preferable for you to consult with an estates lawyer BEFORE you seek appointment as administrator, to find out what your options are with respect to your mother's estate.
