neighbor's plants invading our lawn

Our neihbor's bamboo has grown onto our propery causing damage to the lawn, barn and fruit trees. for years we have trimmed the bamboo on our property, repaired the damage and dumped the cuttings back on the neighbors yard.

A new owner has sent us a letter saying we are trespassing, put up a fence and told us we have to cut the bamboo, but can not dump on their yard.

we think this is wrong and believe we could have someone cut the bamboo, do the repairs and collect in small claims court. is this possible?

Well the first question is how long has this situation existed? Depending on how long its gone on affect whether you can recover.

Did you make any attempt to talk to the original neighbors? Any prior agreements with either neighbor could have a bearing.

Is its something you've tried to talk to the new neighbors about?
