Neighbors Tree

My neighbors tree is dead--one limb has already fallen in my yard--the other limb if it falls will land on the side of my house-the house is abandoned and should be comdemed--but i know who owns the property--are they responsible for removing this tree which is a threat to my house???i just do not want some stupid kid in here with chain saw to remove this tree--it is very large and will be a dangerous job--only for professionals-what is my recourse????thank you sharonlucas

Document the condition using photo (use a film camera rather than digital) and video.

Send a letter to the owner of record notifying him of the condition. Send it certified, registered, return reciept requested and also by regular first class mail. Have another person do the mailings and write an affidavit certifying that they sealed and mailed those envelopes. Preferably a nuetral party.

Contact the zoning officer in your jurisdiction and see what the procedure is. Some jurisdictions allow you to remove the offending branch. Others may allow you to cut the whole tree and send the bill to the owner. Don't do anything until you know for sure.

The key here is to put the owner of record on notice. You can't force them to take action, but if something does happen then they are on the hook for the maximum possible damages.
