New Owner responsible for past zoning code violations?

I just moved into my house on 03/19/04 and recently discovered there were 2 recent zoning code violations regarding my retaining wall that borders a neighbor's property. I have a copy of the letter that was sent on 09/10/03 to the previous owners by the boro in which I live but the inspection company the boro uses has no further record of whether the violations were corrected or not since the inspector who handled this case is no longer there. The previous owner's did make an attempt to correct the problem but did not do an adequate job. In the seller's disclosure there was no mention of this issue. Can I pursue legal action against the previous owners for not disclosing this and would they be responsible for any new repairs that have to be made?
