ownership of property

my dad passed away but my mom's name is still on the deed, however my step mom is saying she owns the house, who really owns it because neither one of them live in the house one of the sons do and he pays all the taxes and keeps up with the house?

It depends on exactly how the deed is worded. If the property was deeded to both your dad and your mom, depending on how it was worded, it may now belong totally to your mom.

The fact that your mom doesn't live there does not affect ownership. Also, the fact that one of the sons does live in the house and pays taxes and maintenance on the house does not make him the owner.

A real estate lawyer should review the exact language of the deed to determine who would own it now.

This is a sticky situation, and you should immediately consult with an attorney who can review the deed and any divorce decree/agreement....

What County are we talking about? How long ago did your dad pass?
