Legal Question in Real Estate Law in Pennsylvania
Parking regulations of condominum association
The bylaws of the condominum states that the only vehicles that can be parked on the premises can only be "licensed, registered, state inspected, operational, four wheeled passenger vehicles" and that no "recreational vehicles, vans, mobile homes, or trucks..." are allowed. I have a Dodge RAM pickup truck, and someone from the management company informed me that I would "have to immediately get rid of it". The classification of pickup trucks is a gray area in the state of Pennsylvania. On one hand, they are registered as a "truck". On the other hand, they fall under the weight class of passenger vehicles. If this case cannot be resolved by the board of directors and ends up going to court, what are our chances of getting the court to agree that my pick-up truck is considered to be a passenger vehicle? Also, there is a no "van" clause in the bylaw. Doesn't that apply to minivans? How about sport utility vehicles? I feel like I'm being singled out.

Re: Parking regulations of condominum association
you said that the bylaws prohibit trucks. Simply put you have a truck. Possibly you could have the bylaws amended to define a larger type of truck. If not, while a truck is a moter vehicle, it is prohibited. A court can't change bylaws. Sorry.
