Legal Question in Real Estate Law in Pennsylvania

Would I Have to Pay out of my Pocket?

The will states that I shall inherit the House and me and my 2 sisters get 1/3 of the money. My Share of the money is 1/3 minus the worth of the house

EG. The house is worth 200,000.00 and their is 900,000.00 In money in inheritance than i shall receive 100,000.000.

My Question is if the Worth of the house was 400,000.00 Instead of 200,000.00 would i have to pay my 2 sisters 50,000.00 each to keep the house?

Also if there was no money left for inheritance. Would I still get the house without paying my sisters 1/3 of it's worth since the house was left to me?

Re: Would I Have to Pay out of my Pocket?

Hard to answer without seeing the instrument but your examples sounds reasonable. Where the instrument (the will) is not specific or is unclear a court probating an instrument will try to deduce the intent of the testator. In this case it sounds like the testator wanted to distribute his/her legacy equitably while also making certain that you got the house. If the only legacy is the value of the house then you have a choice. You can keep the house and pay one third of its value to each sister or sell the house and each person take a third.

As always, seek competent counsel to guide you through.
