Legal Question in Real Estate Law in Pennsylvania

Pennsylvania property right of ways

I recently bought a house. the driveway to my house is also shared by a neighbor. I actually own the property the driveway is on. But the neighbor has an established right of way. However, this right of way was established with the previous owner of MY house. Now that I own the house, is the right of way still valid?

Re: Pennsylvania property right of ways

A right of way or an easement? I think what you have here is an easement. If so the easement should have been documented. For starters an easement is either mentioned in the deed. Or its recorded separately.

When you bought the house a title search should have been done. If you have a mortgage or even just title insurance I can be pretty certain a title search was done.

It sounds like you looked at your deed. So the next step is to ask your neighbor what does he think he got from the previous owner. Does he have anything in writing? Further, is he willing to work out some sort of settlement.

It would be better if you could work this out yourselves but is that possible?

If you have any questions feel free to contact me. The initial consultation is free.
