Legal Question in Real Estate Law in Pennsylvania

Does previous owner have right to claim property after 1 year?

I purchased my property last December. In my original sales agreement, it is stated that two very expensive trees are not included with the sale of the home. However, before closing, the previous owner checked into seeing how much it would be to remove the trees. It was expensive, so she said that the trees would remain. Now, nine months later, and a lot of new landscaping on my part, she comes by and says that she is going to have the trees removed. My argument is that she never stated on the sales agreement that she would remove the trees at a later date and that any of her property that was not included in the sale should have been removed before the closing. Now, Does she have a claim to those trees, and if so, can I charge her a ''holding/storage'' fee for taking care of the trees for the last nine months? Please advise.

I would need to review your sales agreements before I can provide you a definitive answer. It would appear that there may be some type of cause of action depnding on what agrements you have and if they are in writing. You can call my office for a no obligation, no cost initial consultation.
