Private Road Rights
In 1995, we purchased land along a dirt municipal road. In 1997, after 2 years of being constantly hounded by one of the adjoining property owners, we agreed to privatize the road, which we now know was a mistake. No agreements were signed with the other landowners, and we were the only resident on this road. Now, one landowner had parked a delivery truck just before our property line off the private road, thus blocking access. He also has begun to dig up the road on the other side of the delivery truck and construct a building abutting the private road. We no longer have access to travel this direction on the road, nor does emergency or utility vehicles. What can we do? He refuses to move the truck and fix the road.

It is impossible to advise you without a full and complete review of the title and ownership rights for all owners involved. If your access is blocked and you have no other access, a court should grant an injunction to provide you with the right of access. I suggest you consult legal counsel immediately.
