Property damage due to auto accident

Approxamately one year ago a trucker lost fontrol of

his truck due to horrible road conditions and did

damage to my yard and my neighbors yard. When I

spoke to my neighbor she said she heard he was

going to fix the damage himself in the spring. I tried to

contact him to no avail as he not only damaged my yard

he took out one of my hazelnut trees. I have not heard

from him at all. He never returned any of my calls.

do I have grounds for a suit and is there a statute of

limitations for the suit? I do have photos of the damage

that was done.I have already had the damage to my

driveway repaired as it was very necessary.

Yes you can sue, and yes there are statutes of limitations relating to these matters, these are based upon what your civil charges are?

The statute of Limitations for negligence is 2 years. A driver has a duty to maintain control of his vehicle on any road condition he choses to drive on. Chances are he thinks the damages are minimal and wants to pay for them(or repair them) without going through his insurance coverage. I do think you have a case. I offer free consultations.
