Legal Question in Real Estate Law in Pennsylvania
I have a property that has been "going through" foreclosure since 9/6/09. A short sale was denied by BOA. I have current financial needs that cannot be addressed due to the foreclosure being "on hold. BOA referred me to the law firm "handling" this situation. The law firm advised me that the foreclosure cannot proceed until BOA gives the "go ahead". I again contacted BOA. I was told that they cannot give the "go ahead" until permission from the "original investor". The person I spokle with(@ BOA) told me they "cannot" give me that info, but gave me 3 options to get that info. I could get it from the original loan paperwork, I could call BOA customer service & the would tell me how to go about getting the info or I could send them a written request. I feel as though I am getting "the run around". I need guidance on how to proceed with expediting the foreclosure and getting on with my life. I am not able to retain the property. And, at this point, I have no desire to do so. PLEAS HELP!!!

You should always communicate in writing. It is too easy to be ignored if you are telephoning. Your letters will create a paper record that you can refer to, especially if you send the letters by regular AND certified mail, receipt requested.
There are mortgages that are held in a "bundle" with other mortgages, and the bundle is owned by a group of investors. Often, but not always, no changes or agreements can be made about the mortgage without investors' approval.
You might also want to ask [in writing, of course] if the bank will accept a deed-in-lieu of foreclosure. The bank is not required to agree to this.
Your county court may have a special program to deal with foreclosures and you may be able to go through that process to get a response from the mortgage holder.
You may require the services of a lawyer to resolve this.
