Property

In June of 2006 I became a new home owner. During the months following due to the weather my basement has been getting water in it. This fact was not disclose in any of the paperwork from the real estate agent or at closing. Do I have any recourse? Please let me know. Thanks

Your contract or agreement of sale should have included a Seller's Property Disclosure Statement under PA law. You might also have had a home inspection contingency, that gave you the right to have a professional inspection of the home and to cancel if any issues could not be resolved.

If the problem was not disclosed in that document or in the home inspection report, you may have a claim against the seller for not disclosing a condition, and possibly a claim against the home inspection company if the condition could have been determined during a professional inspection. If you did not receive the Seller Property Disclosure, you may be able to make a claim requiring the seller to refund the entire purchase price and you to transfer the home back to the seller.
