real estate access cutoff

My access to my property comes across another property (this road was an old 1940's strip mine road used to hall coal out of job sight) and that property owner wants to cut my access road off.

What are my recourses.

Can he close my access?

I suggest you consult an attorney. There are many issues that have to be investigated. I do believe that you can force the other owner to allow you access especially if you are land locked. Also, the fact that the road has been utilized for in excess of twenty one years may give rise to a prescriptive easement to use the road. However, the facts and issues must be reviewed by an attorney competent in that area. You may want to consider bringing an injunction action to prevent the owner from blocking the road.
