Real Estate Disclosure Problems

When we purchased our home from its previous owner, we naturally had him fill out and sign a "disclosure form". It stated that there were no problems with the house and its construction to his knowledge. Since then there have been several problems with the house. According to our neighbors, the previous owner was well aware of these problems. Do we have any grounds for legal action or do we have to grin and bear it?

You would have a cause of action against the sellers if they intentionally failed to disclose problems with the house of which they were aware. Suggest you assess the value of making repairs versus the cost of proceeding with a law suit. Get

estimates and contact a local attorney or your realtor to see if he can assist. The realtor-salesperson may have some liability in this matter too. Be careful how you proceed. If the salesperson knew of the problems and did not disclose them you may have a legal basis for a claim. However, there are many caveats to this issue and you would be better off meeting with legal counsel.
