Legal Question in Real Estate Law in Pennsylvania

real estate foreclosure

My elderly mother cosigned on a mortgage for my brother and his wife without my knowledge. I have power of attorney for her. Foreclosure proceedings have begun. What financial responsibilities does my mother have? Is there any way to protect her?

Re: real estate foreclosure

Did your mother have mental capacity at the time when she co-signed the mortgage? if not, you should contact the attorney in the foreclosure proceedings to try to release her.

Otherwise, she is fully ["jointly and severally" is how it is probably stated in the mortgage] responsible for the balance owed.
