real estate partition

My ex-husband released all interest and claims to a property we owned valud upon me signing divorce papers. I gave him the divorce. After 7 years he is suing me in court for partition of the property. Is this legal

He should have signed a deed to you and had it recorded in the Department of Records to effect the change in title to the property.

If you had a property settlement agreement that stated your agreement to divorce and his agreement to release all of his interest in the property, you should run to get a local real estate lawyer to help you in defending the partition action.

If you were represented by a divorce lawyer at the time, you may also want to contact the divorce lawyer to find out why you did not receive legal title from your ex-husband.
